What Our Fee Covers

Our fee covers our attorney consultation with you, preparation and professional filing. Through our attorney, we professionally file your application for you and we report all status and correspondence received from the U.S. Patent & Trademark Office to you. Approximately 3-6 months after the filing of your application, it will be reviewed by an Examining Attorney at the US Patent & Trademark Office who may issue an initial refusal called an "Office Action" which may require a response in approximately 6 months. Almost all applications receive an Office Action. Typically, the Office Action is the means by which the Examining Attorney will raise questions or issues that will require us to provide more information about your trademark and its use, however, initial refusals are issued in an Office Action for any number of reasons such as the strength of a trademark applied for and possibly its ability to create confusion to other existing registrations. These refusals can oftentimes be overcome with the right written response resulting in the approval of the application. If an office action is received from the USPTO, or if an opposition is filed against your mark, we will speak with you first in order to arrange services on your behalf at a low hourly rate to address these issues with your prior approval.

Once an application is approved, it will be published for opposition for a period of 30 days. If your application was filed based on use in commerce (meaning that you were able to show you were using your mark at the time of filing), your trademark will register approximately 2-3 months after the opposition period ends and there will be no additional fees to file with the USPTO. If your application was filed based on intent-to-use, we will then have 6 months in which to show the USPTO how you are using your trademark through a Statement of Use filing, please note that there are fees associated with this filing.
